Autism is a topic that presents considerable discussion in the scientific universe as well as in the school environment. It is an increasingly present reality, being evidenced by the advances in research in the area, as well as the definition of its different spectra. Through the survey of the state of the art on the subject of autism and public policies, we sought to understand how autism is classified, the profile of the autistic person, the challenges of education in terms of inclusion and the discussions at the level of public policies that ensured the rights of people with disabilities and autistic people in Brazil. In the last decade, great advances have been made in this area thanks to Law 12764/2012, which deals with the National Policy for the Protection of the Rights of People with Autism Spectrum Disorder, as well as Law 13146/2015 that promulgated the Brazilian Law for Inclusion of People with Disabilities (Disabled Person Statute). With advances regarding the pertinent discussions on how the teaching-learning process should take place through pedagogical tools geared to each specificity, the presence of mediators and the treatment process ensured with the public health service were important aspects highlighted by these laws. The inclusion process is moving towards actually including, as well as encouraging an understanding of plurality and respect for differences. This process has not yet reached its ideal, just as the struggle of those who seek better conditions for autists has not ended, but the conquests already represent advances and better understandings on the subject.
